Prayer by the Petitioners

If the jury shall believe that Gerard Gibson had at the time date of the conveyance other property more than sufficient to pay all the legal Equitable or legal debts due by him to his wife, she is and left enough to pay the amount due her, she cannot question the validity of the deed, under the 29th sec. of the act of 1796.

If the jury shall believe that Gerard Gibson at his death left sufficient property to pay the debt then amount of alimony then due and in the order of this Court to his wife that then she cannot deny the validity of the manumission under the 29th sec. of the act of 1796.

If the Jury believe from the said evidence that the said the Gerard Gibson made the Deed of Manumission offered in evidence while the claim of his wife for alimony was pending & for the purpose of preventing her from recovering said claim, then such deed of manumission was fraudulent & void, & the Petrs are not entitled to their freedom under the said deed. But, that if the jury shall believe that he conveyed them away from the evidence that he made said deed with the view of preventing her from obtaining at his death a distributive portion of his said property, he had a perfect right do to do and the deed is valid

 

such motive for making the said deed is no ground for impeaching its validity
