Emanuel Gilbert v. Horatio M. Ward. Affidavit of Benjamin T. Fendall

On this 8th day of November 1831 before me the Subscriber a Justice of the Peace in and for the County aforesaid personally appeared Benjamin T. Fendall and made oath on the Holy Evangelists of Almighty God that the a negro man named Emanuel who brought a suit against Horatio M. Ward and obtained a verdict in his favor at the May Term of 1831 of the Circuit Court of the District of Columbia for said County of Washington, under the will of the late Peter Dejean of Prince George County Maryland, manumitting said Negro Slave, was at the time of the death of said Djean over the age of forty five years as appears from evidence in the possession of this Deponent, which can be furnished when wanted, and which fact the Defendant states was not in his possession at the time of said trial.
